			<content:encoded><![CDATA[<p>Many people know that they need to avoid asbestos. If you do not avoid asbestos, you could be diagnosed with pleural plaques, or much worse. If you are working in an environment that has older buildings which may contain asbestos-ridden materials, such as insulation, roofing products, cements, fireproofing products, etc&#8230; , you may be at risk for coming into contact with asbestos. Short term, you are most likely not at risk for experiencing any physical complications. Over time however, whether it is twenty or forty years from now, you could find that you have pleural plaques or another asbestos-related medical condition.</p>
<p>Scans and tests performed by your physician can determine whether or not you have developed pleural plaques. Pleural plaques are raised areas of the collagen tissues of the fibrosis that are smooth. They are generally found on the inner surface of the ribcage, on the pleura and on the diaphragm. It takes many years after the initial asbestos exposure for any pleural plaques to form. Some have found that it is not until sixty years after their exposure to asbestos that they are diagnosed with pleural plaques.</p>
<p>Pleural plaques are not painful and they are not life threatening. Because of this, most people who have this condition will never know unless their doctor discovers the plaques through tests and scans that are preformed for other medical conditions. Furthermore, because there is no pain and no life threatening danger associated with pleural plaques, there are currently no cures or treatments options for individuals diagnosed with this condition. It is simply something that you will live with, and your life will not be impaired because of the plaques.</p>
<p>Of course, those who have pleural plaques are at higher risk for mesothelioma because of their exposure to asbestos. Mesothelioma is a life-threatening form of cancer that affects the mesothelial cells lining the lung, chest cavity, abdominal cavity or heart cavity. These cells also cover the outer surface of most internal organs forming a mesothelium, a tissue that helps protect the organs.</p>
<p>It is important to make sure that you are getting regular check-ups and that you discuss your concerns with your doctor. Make sure that your doctor knows about your exposure to asbestos, and you should also disclose when your exposure occurred and for how long you were exposed to it.</p>
<p>If you do have a medical condition, other than pleural plaques, that causes you physical harm, there is the possibility that you may be able to file a lawsuit to recover for damages. The outcome of your case and the damages you may be able to recover are different in every case. Many of the people awarded damages are people who were misinformed by their employers about their working conditions and are ultimately diagnosed with a life-threatening disease as a result.<br />

<p> Available scientific evidence does not support claims that faith healing can cure cancer or any other disease. Even the "miraculous" cures at the French shrine of Lourdes, after careful study by the Catholic Church, do not outnumber the historical percentage of spontaneous remissions seen among people with cancer. However, faith healing may promote peace of mind, reduce stress, relieve pain and anxiety, and strengthen the will to live.</p>
<p> According to proponents, nothing is impossible with faith ,every sickness can be cured by faith , faith can cure blindness, deafness, cancer, AIDS, developmental disorders, anemia, arthritis, corns, defective speech, multiple sclerosis, skin rashes, total body paralysis, and various injuries. Christian Scientists, for instance, believe that illness is an illusion that can be healed through prayer, either for oneself or by trained practitioners.</p>
<p> Faith healing in close proximity to the patient or at a far location from the patient. Faith healing practiced from afar can involve the use of prayer by a single faith healer or a group of praying people. When near to the patient, as in revivalist tent meetings, the healer often touches, or "lays hands on," the patient believing that healing power will flow from a higher supernatural power through his hands unto the sick cancer patient.</p>
<p> Faith healing can also involve a pilgrimage to a religious shrine, such as the French shrine at Lourdes, in search of a miracle. Christian Scientists train and use their own practitioners to heal sick persons through prayer.</p>
<p> Although it is known that a small percentage of people with cancer experience remissions of their disease that cannot be explained, available scientific evidence does not support claims that faith healing can actually cure physical ailments. When a person believes strongly that a healer can create a cure, a "placebo effect" can occur. The placebo effect can make the person feel better, but it has not been found to induce remission or improve chance of survival from cancer.</p>
<p> The patient usually credits the improvement in how he or she feels to the healer, even though the perceived improvement occurs because of the patient's belief in the treatment. Taking part in faith healing can evoke the power of suggestion and affirm one's faith in a higher power, which may help promote peace of mind. This may help some people cope more effectively with their illness.</p>
<p> People who seek help through faith healing and are not cured may have feelings of hopelessness, failure, guilt, worthlessness, and depression. In some groups, the person may be told that his or her faith was not strong enough. The healer and others may hold the person responsible for the failure of their healing. This can alienate and discourage the person who is still sick.</p>
<p> Relying on this type of treatment alone and avoiding or delaying conventional medical care for cancer may have serious health consequences. Death, disability, and other unwanted outcomes have occurred when faith healing was elected instead of medical care for serious injuries or illnesses.</p>
<p> Even if you decide to use faith healing as means of treating your mesothelioma cancer do not neglect the use of your prescribed medical treatment, use your faith treatment as form of complementary therapy for your faith, after all if both therapies are working for the same goal ,continuing your normal treatment should not negate your faith.</p>
<p> Finally, a few "faith healers" have been caught using fraud as a way to get others to believe in their methods. Do not give anybody money to pray for you or heal you.</p>

<p> And Aetna Insurance said that asbestos was "incurable" in a 1934 Attorney's Textbook of Medicine. The insurance company went on to say that disability typically followed exposure to asbestos and that the disability was followed by death.</p>
<p> Information about asbestos-related diseases started to pile up over the next 40 years Companies that were the giants of the asbestos industry were well aware that the inhalation of asbestos fibers led to asbestosis, lung cancer, and death.</p>
<p> Yet, instead of helping their employees they instead chose to "sweep this information under the rug." They just would not commit to the extra expenses that would have been involved with changing their procedures and making it safer for their employees to do their jobs.</p>
<p> Then, in the 1970s, the United States government began to get more involved. Government agencies attempted to educate the public about the dangers associated with asbestos. The government established guidelines for companies to follow. The US government warned companies that they should provide protective gear that would better protect their employees.</p>
<p> Yet these warnings, for the most part, fell upon deaf ears.</p>
<p> Internal correspondence, memos, and reports from that era show that even though some manufacturers and companies knew about the dangers associated with inhaling and/or swallowing asbestos fibers they instead chose to continue to use asbestos without protecting their workers.</p>

<p>In the matter of Wyeth v. Levine, the Supreme Court ruling came down against Wyeth. This is known as the &#8220;Preemption&#8221; case. A ruling in the other direction would have wiped out the pharmaceutical mass tort industry and taken away all of our protection as consumers relating to drug safety. The following article was published on March 4, 2009, the day of the ruling.</p>
<p>The Supreme Court today upheld the right of patients who are hurt by a prescription or over-the-counter drug to sue the drug maker for damages. The 6-3 decision rejected a strong move by the Bush administration and the pharmaceutical industry to shield drug makers from lawsuits if their products were approved by the Food and Drug Administration. At issue were suits involving the more than 11,000 drugs on the market in the United States. The outgoing Bush administration told the court last fall that federal approval of a drug &#8220;preempts,&#8221; or bars, juries from deciding whether it is unduly dangerous. But the high court, led by Justice John Paul Stevens, disagreed and said Congress had not taken away the consumer's right to sue. He said the view of the Bush administration "does not merit deference," particularly considering that the FDA prior to the Bush era had favored lawsuits as a means of protecting consumers from dangerous drugs.&#8232;</p>
<p>Today's ruling upholds a nearly  million jury verdict in favor of a Vermont musician whose right arm was amputated after she was injected with an anti-nausea drug made by Wyeth. The injection struck an artery and caused gangrene, a rare but occasional complication from directly administering Phenergan, the anti-nausea drug. Diana Levine, the Vermont woman, settled a suit against the clinic that gave her the injection and then sued Wyeth. She contended that the drug maker had not properly warned her and other consumers of the danger. In its defense, Wyeth said the federally approved warning label told doctors and nurses to use extreme caution when injecting the drug. Levine and her lawyers said that was not sufficient. Who would take an injection to relieve nausea, she asked, if a patient knew she could lose her arm as a result? The jury agreed with her and awarded her .7 million in damages. In its appeal in Wyeth v. Levine, the drug company argued that since the FDA had approved its warning label as adequate, a jury should not have the power to second-guess this conclusion. &#8220;Congress has repeatedly declined to preempt state law,&#8221; Stevens said today. &#8220;Wyeth has not persuaded us that failure-to-warn claims like Levine's obstruct the federal regulation of drug labeling.&#8221; Justices Anthony M. Kennedy, David H. Souter, Ruth Bader Ginsburg and Steven G. Breyer agreed with him. Justice Clarence Thomas concurred in the result. Thomas has been reluctant to go along with decisions that say federal regulations trumps state law. The dissenters were Chief Justice John G. Roberts Jr. and Justices Antonin Scalia and Samuel A. Alito Jr. &#8220;This case illustrates that tragic facts make bad law,&#8221; Alito wrote. He called the result &#8220;a frontal assault on the FDA's regulatory regime for drug labeling.&#8221;</p>
<p>The defense argued that because the federal government (via the FDA) regulates drugs, patients should not be allowed to sue in state court when drug makers follow the rules established by the FDA. Fortunately, the court rejected this argument. Justice Stevens wrote the majority opinion, &#8220;We conclude that it is not impossible for Wyeth to comply with its state and federal law obligations.&#8221; He was joined in his opinion by Kennedy, Souter, Ginsburg, and Breyer. Thomas wrote an opinion that was in agreement with this. But Roberts Alito, and Scalia dissented.</p>
<p>Wyeth&#8217;s lawyer was quoted saying, &#8220;We believed that Federal law prohibited the company from revising its product label as the Vermont court required, and we regret that the Supreme Court disagreed. The medical and scientific experts at FDA are in the best position to weigh the risks and benefits of a medicine and to assess how those risks and benefits should be described in the product&#8217;s label.&#8221;</p>
<p>Levine&#8217;s lawyer commented on the ruling, &#8220;The Supreme Court&#8217;s opinion reaffirms the important role state law plays in promoting consumer safety and providing compensation for injuries. More importantly, the decision permits Ms. Levine to put this chapter behind her and to move on with her life.&#8221;</p>
<p>In a story that received coverage from many news sources, the New York Times (3/5, A1, Liptak) reports on its front page, "In a major setback for business groups that had hoped to build a barrier against injury lawsuits seeking billions of dollars, the Supreme Court on Wednesday said state juries may award damages for harm from unsafe drugs even though their manufacturers had satisfied federal regulators." The decision "could have significant implications beyond drug manufacturing" and "many companies have sought tighter federal regulation in recent years in part to shield themselves from litigation."</p>
<p>The Washington Post (3/5, A2, Barnes) reports, &#8220;The 6 to 3 vote in the court's most anticipated business decision of the term was a rejection of Bush administration policy and a major setback to pharmaceutical companies, which face thousands of lawsuits in state courts from patients who allege that drugs have harmed them.&#8221;</p>
<p>The Associated Press (3/5) reports, &#8220;The Supreme Court&#8221; upheld &#8220;a .7 million jury award to a musician who lost her arm to gangrene following an injection.&#8221; The plaintiff, &#8220;Diana Levine of Vermont once played the guitar and piano professionally&#8221; and &#8220;her right arm was amputated after she was injected with Phenergan, an anti-nausea medicine made by Wyeth Pharmaceuticals, using a method that brings rapid relief, but with grievous risks if improperly administered.&#8221; There were many other outlets that covered the Wyeth ruling, including: Business Week (3/5, Johnson), CBS News (3/5, Cohen), the San Francisco Chronicle (3/5, Egelko), the Wall Street Journal (3/5, Bravin), the Legal Times (3/5, Mauro) reports, the AP (3/5, Curran), the Legal Intelligencer (3/4, Passarella), the Los Angeles Times (3/5, Savage), Dow Jones Newswires (3/5, Anderson), USA Today (3/5, Biskupic, Appleby), UPI (3/4) ABC World News (3/4, story 9, 0:30, Gibson), CBS Evening News (3/4, story 4, 2:00, Couric) and NBC Nightly News (3/4, story 5, 2:05, Williams).</p>
<p>Drug industry may face more litigation after ruling. The Financial Times (3/5, Jack) reports, &#8220;Pharmaceutical companies face substantial extra litigation after the US Supreme Court ruled yesterday that safety warnings on their drugs approved by federal regulators did not protect them from lawsuits in individual states.&#8221; The ruling &#8220;marks the failure of efforts by the industry to fight legal settlements by imposing federal pre-emption, an argument that had been supported by George W. Bush's administration.&#8221;</p>
<p>Bloomberg News (3/4, Stohr) reported that now drugmakers can be sued &#8220;for failing to provide adequate safety warnings.&#8221; Justice John Paul Stevens wrote in the opinion, &#8220;Congress did not intend FDA oversight to be the exclusive means of ensuring drug safety and effectiveness.&#8221; The ruling &#8220;might help former users of Wyeth's Prempro and Premarin menopause drugs and consumers of AstraZeneca Plc's antipsychotic drug Seroquel.&#8221; However, &#8220;the impact isn't clear for allegations that Pfizer Inc. and GlaxoSmithKline Plc should have done more to warn that their anti-depressants might cause suicidal tendencies.&#8221;</p>
<p>The Philadelphia Inquirer (3/5, Hill) reports that Sol Weiss, a Philadelphia plaintiffs' lawyer, said, &#8220;This doesn't mean you're going to win, but you get your day in court.&#8221; He is &#8220;not involved in this case&#8221; but &#8220;he is hoping that the decision will revive his cases involving Pfizer Inc.'s antidepressant Zoloft and GlaxoSmithKline P.L.C.'s antianxiety agent Paxil.&#8221; The Wall Street Journal (3/5, Johnson, Mundy, Bravin) also covers the story.</p>
<p>Ruling may make drugmakers more cautious, halt development. The AP (3/5) reports that the ruling &#8220;could make drugmakers more cautious about safety issues and may lead them to halt development of some medicines and even pull others off the market.&#8221; Erik Gordon, an analyst and professor at University of Michigan's Ross School of Business, said, &#8220;They will weigh how prevalent the side effect is, how serious the side effect is, versus the number of people benefiting from the drug and the amount of money being made by the drug.&#8221;</p>
<p>Ruling seen as contradictory to medical device case. The New York Times (3/5, B1, Meier, Singer) reports on the front page of its Business Day section that the &#8220;result of a decision Wednesday by the Supreme Court&#8221; was that &#8220;federal law does not protect drug companies from product liability suits in state courts.&#8221; However, &#8220;in contrast, the Supreme Court ruled last year that federal law does bar such lawsuits against the makers of heart stents, artificial joints and other critical medical devices.&#8221; David C. Vladeck, a professor at Georgetown University Law Center, said, &#8220;I think this is going to force Congress to revisit the issue of why medical devices should be insulated from lawsuits.&#8221;</p>
<p>Wyeth loss seen as possible victory in disguise. Forbes (3/5, Fisher) reports, &#8220;Wyeth's loss dashes the hopes of those who support pre-emption as a tactic for cutting back on excessive jury awards in product-liability cases, which the court affirmed last year in Riegel v. Medtronic.&#8221; However, &#8220;Wyeth v. Levine may be a victory in disguise. By stepping back from the brink and refusing to give drug companies federal immunity from suits under state laws, the court has likely prevented an even more toxic response from the Democrat-controlled Congress.&#8221;</p>

In an op-ed in the Detroit Free Press (3/5) Henry Greenspan, who teaches about the FDA, ethics and policy at the University of Michigan, writes, &#8220;Today was a good one for justice in America &#8211; but we in Michigan remain saddled with a law that is based on precisely the argument the high court rejected.&#8221; He adds that the court's decision in Wyeth &#8220;is not enough to end Michigan's statute.&#8221; Greenspan concludes, &#8220;The state senators who have blocked repeal will now have to argue that they know better than two-thirds of the Supreme Court&#8221; and &#8220;they will have to explain why they maintain a view of the FDA that the court called &#8216;meritless&#8217; and &#8216;untenable.&#8217;&#8221;</p>

			<content:encoded><![CDATA[<p>The telecommunication international markets are a large revenue source for today and a huge growth opportunity for tomorrow but at what price?</p>
<p>The market is huge, by any standard. Compared to the United States (295 million), Europe has far more people (730 million). The Europe, Middle East and Africa regions are home to 40 percent of the Fortune 2000 companies, many of which are becoming much more global and much more dependent on telecommunication products and services. With hundreds of millions of customers and soaring demand -- does it get any better than that for the telecommunication industry with the revenue potential of a whopping: - billion a year?</p>
<p>There's no shortage of competitors in these regions ready and willing to meet the needs of the unsuspected consumer. Verizon, BT (formerly British Telecom), Equant (part of France Telecom), Cable &amp; Wireless, Nexagent, Vanco, T Systems (part of Deutsche Telekom) and Colt Telecom are some of the more prominent players.</p>
<p>A large percentage of the United States based telecommunication companies revenue today come from Western European countries such as the United Kingdom, France, Belgium, Germany, and the Netherlands. But the buzz lately is; that the fastest growth will come from the region's periphery -- Scandinavia, Eastern European nations like the Czech Republic and Croatia and parts of the Middle East such as Qatar and Dubai.</p>
<p>The money is flowing and so also are the major players in the telecommunication industry. But there's a little problem! There's a wireless monkey on their back and it's not letting go, it's the issue of electromagnetic pollution. The rapidly growing health concern related to wireless and land-line EMF emitting devices such as cell phones, cordless phones, cell phone towers, electrical power lines and much more.</p>
<p>The continuing debate between a potential health epidemic, independent research institutes, the World Health Organization (WHO) and the telecommunication industry should be labeled as the "Early Warning Replay Cover-Up".</p>
<p>Starting with Dr. George Carlo, a leading researcher, public health scientist, and epidemiologist who was hired by the cell phone industry back in 1993 as Chief Scientist for the world's largest research effort into wireless safety, a 25 million dollar program. In 1999, his research funds were not renewed, and the industry sought to discredit him. His findings on the dangers posed by cell phones included, disrupting cardiac pace makers, penetrating the developing skulls of children, compromising the blood brain barrier, and most startling, inflicting genetic damage that is a known diagnostic marker for cancer.</p>
<p>Public awareness has been growing as bits and pieces of recent media reports are released, validating and discrediting each others findings. But on March 18, 2005 a federal appeals court, based on scientific evidence that links cell phone usage to DNA damage, brain tumors, Alzheimer's disease, cancer and more... "Ruled cell phone makers could be sued in state court over claims that wireless equipment emits unsafe levels of radio frequency radiation."</p>
<p>Safety standards for cell phones and other EMF emitting devices vary from country to country. It took decades for governments to respond to early warnings about tobacco, radiation and asbestos. And with cell phones, a relatively new technology with worldwide subscriptions approaching 1.7 billion and marketers turning their attention to children, should we have similar concerns?</p>
<p>In 1856 the Lancet medical journal debates health effect of tobacco. In 2005 tobacco was found to be responsible for one in 10 adult deaths worldwide.</p>
<p>In 1896 injuries from X-rays were noted by scientists, including Thomas Edison. In 1990 risk of radiation cancer found to be up to 5 times greater than previously thought. In1996 European Union sets limits for occupational exposure to X-rays.</p>
<p>In 1898 UK factory inspects or warns of harmful effects of asbestos dust. 1918 U.S. insurers refuse to cover asbestos workers' claims. 1998 - 99 European Union and France ban all forms of asbestos. 2000-01 World Trade Organization upholds ban against Canadian appeal.</p>
<p>1983 Motorola launches first commercial cell phone. 1993 man claims on CNN that his wife died of tumor caused by cell phone. U.S. Cell phone industry funds and launches research to prove cell phones are safe. 1999 Cell phone industry insider says serious health risks are being ignored. 2004 U.K. Health Protection Agency warns about non-essential use by children. 2005 U.S. Federal Appeals Court ruled cell phone makers could be sued in state court over claims that wireless equipment emits unsafe levels of radio frequency radiation.</p>
<p>With the emerging of new markets and the supply and demand of modern wireless technology; the billion dollar telecommunication industry will continue to seek out additional revenue sources. With sites set on their targets; they will move forward, even with that monkey hanging on their back. The cell phone/ telecommunication industry continues to deny the existence of a problem, and governments around the world continue to sort out both legal and ethical entanglements with the industry that render them impotent in terms of protecting consumers. It's a shame that the industry that we all depend on for our telecommunication needs cannot learn from early warnings and lessons from the past. In the end the public will suffer and the price we pay will be much greater than the industry can ever produce. What price will that be? The price of our Children!</p>
